Terms of Use
Please read these terms and conditions carefully before using our website or making a reservation. These terms of use apply to all our services. By using our website and making a reservation through our booking platform, you agree to be bound by the below terms and conditions which constitute an agreement between Wave of the Day Surf Travel Pty Ltd and you. If you do not agree with these terms, please do not use our services. Our terms may be amended from time to time, and if so, a revised document will contain the updated date. Individual packages may have additional information and/or terms and conditions. This information can be found on the individual package page and also again in your booking confirmation email. This information is legally binding and by proceeding with a booking you acknowledge you have read and understood this information.
Prices and Payment Information
All prices are quoted in Australian Dollars unless otherwise stated. All credit card payments are subject to a 2% booking fee. All packages and prices quoted are subject to availability and can be withdrawn or varied without notice. As all our packages are advertised at discounted rates, often close to date of travel, full payment is required to proceed with a booking. Once a booking is made, we will confirm your arrangements with our providers. Wave of the day reserves the right to cancel any booking if the provider is unable to confirm the booking. If a trip is cancelled by Wave of the Day, a full refund can be provided.
Booking Fees
All credit card payments are subject to a 2% booking fee. You agree that you will not seek to ‘charge back’ your payment to Wave of the day.
Booking Confirmation
Once you’ve made payment for your booking you will receive a booking confirmation email with important information regarding your package. Please read this information carefully. If you notice any errors or have any questions regarding your booking, please reply to this email within 24 hours. Sometimes we will request additional information. If so, it is your responsibility to provide this information.
Travel Documents
All travel documents are non-transferable. All tickets must be in the name of the passport holder who is the original participant at time of booking. In some circumstances, name changes may be available. Wave of the Day will assess this on a case-by-case basis. It is your responsibility to ensure you have received all travel documents from us prior to travel. Please contact us 2 weeks prior to departure if you have not received your documents.
Cancellations and Refunds
For Cancellations outside of 90 days, you will forfeit a 30% cancellation fee. Cancellations within 90 days are non-refundable. For all cancellations, we are unable to provide refunds on booking fees. Please ensure you have the relevant travel insurance to cover you in the case of unforeseen events. Wave of the day is unable to provide any refund to you until we receive the funds from the relevant operator. Any legal recourse over refund is with the specific operator and not with Wave of the Day.
Operator/Provider Changes and Cancellations
Some operators, specifically boat charter providers, require a certain amount of participants for the trip to take place. If this is the case, it will be stated in the individual package terms and conditions (see ‘Terms of use’). If there is a change to your booking or a cancellation, we will contact you with this information. We cannot accept any responsibility or liability for changes made to your booking by specific operators.
Agency
Wave of the day acts as an agent only, selling travel related products on behalf of numerous third party travel service providers (also referred to as ‘providers’ or ‘operators’). While we do our best to only partner with the best operators, we have no responsibility for their services nor do we make or give any warranty of representation regarding their standards. Any legal recourse is against the specific provider and not Wave of the day. If the travel service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not against Wave of the day.
Liability
Wave of the Day does not accept any liability for the acts of third party providers. Additionally, we do not accept any liability for any injury, damage, loss, additional expense, or inconveniences caused by any events which are beyond our control. We accept no responsibility for climatic conditions that do not match your expectations. All activities engaged in are solely at your own risk and of your own choice.
Privacy Policy
Wave of the Day is committed to protecting your privacy and personal information and we take appropriate measures to safeguard this information. In order to make a reservation using our platform we require some personal information such as your name, email address and passport number. To confirm a booking, we must pass on this information to our service providers. We will not pass on any of your details to any other parties unless you first authorize us to do so.
Travel Insurance
Wave of the Day strongly recommends taking out the appropriate travel insurance at the time of booking. Travel insurance which includes both medical evacuation and surf coverage is also compulsory for many of operators. Please visit our Travel Insurance page for more information. Whilst we recommend world nomads on our website we have no responsibility for their services nor do we make or give any warranty of representation regarding their standards. Under no circumstance will Wave of the Day be responsible or liable for any costs/damages incurred as a result of inadequate insurance, lack of insurance or non-compliance of insurance obligation by the Operator, you or any third party.
Immigration Requirements
You are responsible for ensuring that you have valid passports, visas, and any other permits or immigration requirements required for your destination country. Please ensure your passport has at least 6 months’ validity. Wave of the Day are not responsible for any additional charges incurred. For additional information regarding travel and Visas, please visit www.smartraveller.gov.au or contact the Consulate or Embassy of the country that you are visiting.
Taxes
Some destinations may impose additional taxes such as airport taxes, visa taxes, or surf taxes in certain areas. We will provide any requested information to the best of our knowledge at time of request, but make no guarantees and accept no liability for changes. You are fully responsible for any additional fees or taxes.
Health and Vaccinations
Some destinations require certain health and vaccination requirements be met for travel. It is your responsibility that you carry all necessary vaccination and medical documents. Please consult a GP regarding this information, and visit www.smarttraveller.gov.au for additional information. Wave of the Day is not responsible for providing this information.
Travel Advice
Please visit www.smarttraveller.gov.au for up to date travel advice. This is a free service which is operated by the Department of Foreign Affairs and Trade. Please consider this information before making a reservation.
Governing Law
This agreement will be governed and interpreted in accordance to the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of the State of New South Wales.
